1. Third-party logos and trademarks
WinPhoto operates an editorial directory of photography competitions. To help photographers identify the competition behind each listing, we display the organizer's own published logo next to the listing — the same image the organizer makes available for link previews via og:image, apple-touch-icon, or favicon meta tags on their public website.
All trademarks, service marks, logos, names, and brand identifiers shown on this site are the property of their respective owners. WinPhoto claims no rights in them. Display is informational and editorial — it does not imply sponsorship, endorsement, partnership, or any other affiliation between WinPhoto and the competition shown.
We rely on the doctrines commonly known as nominative fair use (US) and the "honest practices" exception under Article 14 of EU Trademark Directive 2015/2436: a third party may use another's mark to identify that party's goods or services, provided the use is necessary to identify, no more is used than required, and there is no suggestion of endorsement.
2. How we source the marks
Logos are either:
- Hand-curated: for the small set of competitions we list, we save a single small PNG of the organizer's published logo, used at thumbnail size in our listings.
- Auto-fetched: for competitions submitted via our public submission flow, our index bot fetches the organizer's published
og:image/apple-touch-icon. The bot identifies itself asWinPhoto-IndexBot/1.0 (+https://winphoto.io/about-bot)and respects standard fetch hygiene (8-second timeout, 1.5 MB cap, no following of suspicious redirects).
We do not crop, distort, or composite organizer marks. We do not display photographic content owned by competition entrants — only the organizer's own brand mark. We do not attempt to reproduce visual style in a way that could mislead a reasonable visitor into thinking we are the organizer.
3. Takedown procedure — for rights holders
If you are a competition organizer, an authorized representative, or a rights-holder and you would prefer that we not display your logo on WinPhoto, email us and we will remove it. No legal threats or formal notices required — a plain request is enough.
Send to hello@winphoto.io with subject "Logo takedown — [competition name]" and include:
- The competition name as it appears on WinPhoto, or the URL of the listing.
- Your role (organizer, authorized representative, designated agent).
- Whether you want us to (a) remove the logo and fall back to our generic monochrome mark, or (b) remove the entire listing.
Our commitment: we acknowledge within 24 hours and act within 72 hours. If your request is for option (a) we'll fall back the listing to the generic monochrome mark while keeping the directory entry — this preserves the organizer's discoverability for photographers searching for them. If your request is for option (b) we'll remove the listing entirely.
4. Copyright (DMCA-style)
For any claim that copyrighted material is being displayed without authorization — for example, if you believe a logo we display is itself owned by a third party who has not authorized our use — please send a notice to hello@winphoto.io with subject "Copyright notice" including:
- Identification of the copyrighted work.
- Identification of the material on WinPhoto you allege is infringing, with enough detail for us to locate it (URL of the listing).
- Your contact information.
- A statement that you have a good-faith belief that the use is not authorized by the owner, agent, or law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or are authorized to act on the owner's behalf.
- Your signature (electronic is fine).
We follow the same 24h-acknowledge / 72h-act timeline.
5. WinPhoto's own marks
"WinPhoto", the WinPhoto logotype, and the dove-and-photograph mark are unregistered trademarks of WinPhoto (common-law trademark rights established through use). Trademark registration is in progress and will be noted here once granted. Use of WinPhoto's marks by third parties for purposes other than nominative reference (e.g., directory listings of WinPhoto, news articles, link previews) requires written permission.
